YOZY – an online application containing recorded stories and educational games for the language development, attention, memory, and imagination of children.YOZY is an online product under the INTUITEXT brand, owned by SC Softwin SRL, intended for children who want to watch recorded stories and use story-based games.The application includes a series of recorded stories and games developed in collaboration with education specialists to contribute to the language, attention, memory, and imagination development of children. IF YOU DO NOT AGREE WITH THE CONDITIONS AND TERMS SPECIFIED HERE, PLEASE DO NOT ACCESS AND USE THIS PRODUCT. BY ACCESSING AND USING THIS SOFTWARE PRODUCT IN ANY WAY, YOU DECLARE THAT YOU FULLY UNDERSTAND THE TERMS OF THIS LICENSE AGREEMENT, WHICH YOU ACCEPT IN ITS ENTIRETY. This License Agreement represents the sole regulation of the legal relationships established between you (whether an individual or legal entity) and SOFTWIN S.R.L. with its registered office in Bucharest, Sector 1, Str. Maguricea no.20, bl. 7P, sc.1, fl.2, ap. 7, Registration No.: J40/11207/1991, VAT ID: RO1569706, for the use of this software product, owned by SOFTWIN and hereinafter referred to as the Product. All intellectual and industrial property rights, copyright, product and service names, documentation, and accompanying usage instructions belong to SOFTWIN and are protected by the laws of Romania and international copyright treaties. By using the Product, you agree to the terms of this agreement.PRODUCT LICENSEThe Product is protected by the Copyright Law of Romania and international copyright and intellectual property treaties. The Product is licensed and not sold, meaning the user acquires the right to use the product under the terms and conditions of this Licensing Agreement. The usage license is non-exclusive, personal, non-transferable, and operates only within the territory of Romania. The duration of the usage license is established for each purchased package based on the user’s choice. Package details and subscriptions are displayed on the website in the commercial presentation sections for purchasing, as well as in the user’s personal account settings.SOFTWARE APPLICATIONA usage license gives you the right to use the Product from any device through a web connection. Accessing and using the content is only possible after the user authenticates within the application using a username and a personal password.LICENSE TERMSThe granted license starts from the date you activate the Product for the first time. Product activation is done by entering the license code received upon purchasing a license into the application. License codes are unique and generated by SOFTWIN. They will be transmitted to the buyer/user either electronically (via email) or in physical format as a printed certificate. Once the license code is entered into the application in the corresponding section, it will be automatically verified by the application and, if valid, activated. The license code is entered only once, upon the first access. After license activation, entering the license code is no longer necessary. However, it is recommended to keep the licensing certificate or email containing the license code for any eventualities.COPYRIGHTAll rights, title, and profits over and from the Product, as well as copying rights for the Product (including but not limited to any images, photographs, animations, videos, audios, texts, and codes embedded in the Product) and all accompanying materials, are the property of SOFTWIN. Therefore, you must treat the Product like any other copyrighted material. You may not make copies of the Product screens or any parts thereof. Sub-licensing, renting, selling, or leasing the Product is prohibited. Additionally, activities such as piracy, recompilation, disassembly, creation of derivative products from the Product or its parts, modification, translation, or any attempt to discover the Product source code are also prohibited. The user does not have the right to use the name SOFTWIN, logos, or registered trademarks in any form. The user is liable to SOFTWIN for all violations of these rights.WARRANTY LIMITATIONSOFTWIN guarantees that the Product will be available online 24 hours a day, 7 days a week, allowing unlimited access to the Product throughout the chosen subscription/package period. In extreme cases where it is necessary to stop servers or temporarily limit access to the Product for maintenance or technical fixes, the downtime period will be announced to all users on the website’s homepage at least 2 hours in advance and will not exceed 48 hours. THIS IS A LIMITED WARRANTY AND IS THE SOLE WARRANTY GRANTED BY SOFTWIN. SOFTWIN GRANTS NO OTHER EXPRESS OR IMPLIED WARRANTIES. THE DURATION OF THE GRANTED WARRANTY IS LIMITED TO THE LICENSE VALIDITY PERIOD. NO AGENT OR EMPLOYEE OF SOFTWIN HAS THE RIGHT TO MAKE EXTENSIONS OR ADDITIONS TO THE WARRANTIES. SOFTWIN DOES NOT GUARANTEE THAT THE PRODUCT CAN BE USED WITH HARDWARE OR SOFTWARE EQUIPMENT OTHER THAN THOSE SPECIFIED IN THE HARDWARE AND SOFTWARE CONFIGURATION GUIDELINES. SOFTWIN DOES NOT GUARANTEE THE ABSENCE OF ERRORS OR THAT THEY WILL BE CORRECTED. SOFTWIN DOES NOT GUARANTEE THAT THE PRODUCT WILL MEET YOUR REQUIREMENTS. ANYONE USING, TESTING, OR EVALUATING THE PRODUCT WILL BEAR ALL RISKS ARISING FROM ITS USE. UNDER NO CIRCUMSTANCES, WHETHER DUE TO ANY JUDICIAL OR CONTRACT PRACTICE OR OTHERWISE, SOFTWIN, ITS SUPPLIERS, OR DISTRIBUTORS WILL BE LIABLE TO THE USER OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, OR SPECIAL DAMAGES OF ANY NATURE, INCLUDING BUT NOT LIMITED TO COMPUTER ERRORS OR MALFUNCTIONS, WORK STOPPAGE, OR ANY OTHER COMMERCIAL DAMAGES AND LOSSES, OR FOR ANY DAMAGES THAT EXCEED THE PURCHASE PRICE OF THE PRODUCT AND ACCOMPANYING DOCUMENTATION, EVEN IF SOFTWIN HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. The conditions set out in this section will apply regardless of whether you use, evaluate, or test the Product. THIS SOFTWARE MAY CONTAIN ERRORS AND IS NOT DESIGNED FOR USE IN AN ENVIRONMENT THAT INVOLVES A HIGH DEGREE OF RISK AND REQUIRES HIGH PERFORMANCE. THIS SOFTWARE PRODUCT IS NOT INTENDED FOR USE IN AVIATION OPERATIONS, THE NUCLEAR SECTOR, OR IN COMMUNICATION SYSTEMS, ARMAMENT SECTOR, DIRECT OR INDIRECT LIFE SUPPORT SYSTEMS, AIR TRAFFIC CONTROL, OR ANY OTHER APPLICATION OR INSTALLATION WHERE AN ERROR COULD RESULT IN DEATH, SEVERE PHYSICAL INJURY, OR PROPERTY DAMAGE. AT YOUR OPTION, YOU CAN SEND STATISTICS RELATED TO THE NUMBER OF ACCESS ON DIFFERENT SECTIONS OF THE APPLICATION TO THE INTUITEXT SERVER; THE INFORMATION IS GENERAL AND DOES NOT CONTAIN YOUR PERSONAL DATA. THIS INFORMATION WILL BE STORED IN OUR DATABASE AND WILL BE USED BY SOFTWIN TO ANALYZE THE PRODUCT’S QUALITY AND FOR ITS FURTHER IMPROVEMENT. In the event of invalidity of any clause in this License Agreement, such invalidity will not affect the other components of this agreement.
